Mayna AI Terms of Service

1. Who May Use the Services

You must be at least 18 years old, or the legal age of majority in your jurisdiction, and legally able to enter a binding contract. You may not use the Services if prohibited by applicable law.

2. User Accounts, Subscriptions and Free Trials

2.1 Creating and Safeguarding Your Account

To use certain features, you must create an account or link another account such as Google, GitHub or Microsoft. You are responsible for account security, account activity and keeping credentials confidential. Notify us immediately at security@mayna.ai if you suspect unauthorized access.

2.2 Subscription Payment

Paid subscriptions require payment of applicable fees and taxes. We may update pricing or plan structure with reasonable notice. Non-payment may result in suspension or termination of paid access.

2.3 Payment Provider Terms

We use Stripe and related providers for payment processing. By using paid services, you agree to applicable Stripe terms and privacy practices.

2.4 Renewals and Cancellations

Subscriptions renew automatically unless canceled before renewal. You can cancel from your subscription page in the dashboard, and cancellation applies at the end of your current billing cycle.

2.5 Refunds

Except where required by law or stated otherwise, subscription payments are non-refundable.

2.6 Free Trials

Trial availability, duration and eligibility are determined by Mayna. If a trial converts to a paid subscription, your payment method may be charged unless you cancel before the trial ends.

2.7 Promotional Codes

Promotional codes are subject to additional terms, may expire, may be revoked, and are not redeemable for cash unless required by law.

3. Privacy and Acceptable Use

Our Privacy Policy explains how we handle personal information and is available at /privacy-policy. Your use of the Services must also follow our acceptable use and safety requirements.

4. Rights We Grant You

4.1 Right to Use Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right to use the Services.

4.2 Restrictions

• No reverse engineering, scraping, unauthorized automation, or bypassing safeguards.
• No unlawful, deceptive, harmful, abusive, hateful, or infringing use.
• No impersonation or misuse of another person's voice or identity without consent.
• No use that violates applicable law, third-party rights, or platform policies.
• No use of Outputs to build competing models/services where prohibited.

4.3 Beta Offerings

Beta features are provided "as is" and may contain issues. Use of beta features is voluntary and at your own risk.

5. Ownership and Content

5.1 Service Ownership

The Services, including software, branding and related materials, are owned by Mayna or its licensors and protected by intellectual property laws.

5.2 Inputs and Outputs

You retain rights in your Inputs and Outputs to the extent provided by law. Because AI systems may generate similar outputs for multiple users, uniqueness of Outputs is not guaranteed.

5.3 License to Operate Services

You grant Mayna a worldwide, royalty-free license to host, process, store, reproduce and use Your Content as needed to operate, secure and improve the Services, and to comply with legal obligations.

5.4 Feedback

If you submit feedback, we may use it without restriction or compensation to you.

5.5 Copyright Notices

If you believe content on the Services infringes your rights, contact security@mayna.ai with sufficient detail so we can investigate.

6. Third-Party Services and Materials

Services may include links, integrations or content from third parties. We do not control and are not responsible for third-party services, and your use of them is subject to their own terms.

7. Disclaimers, Limits of Liability and Indemnity

7.1 Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

7.2 Limitation of Liability

To the extent permitted by law, Mayna and its affiliates are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill. Aggregate liability is limited to the greater of amounts you paid for relevant services in the prior six months or USD 100.

7.3 Indemnification

You agree to indemnify and hold harmless Mayna and its affiliates from claims, losses and expenses arising from your breach of these Terms, misuse of Services, or infringement of third-party rights.

8. Arbitration and Class Action Waiver

Please read this section carefully. Except where prohibited by law, disputes may be resolved by binding individual arbitration, and class actions may be waived. You may have a limited right to opt out by contacting us within the required timeframe after first agreeing to these Terms.

9. Additional Provisions

• We may update these Terms from time to time; updates are effective when posted.
• We may suspend or terminate access for violations, risk, abuse or legal reasons.
• If part of these Terms is unenforceable, remaining provisions stay in effect.
